Terms of service

These Terms of Service govern your use of the Gordina website and any purchases you make from us. By using our website or placing an order, you agree to these Terms and the policies referenced below.

Nothing in these Terms limits any mandatory rights you have under Dutch or other applicable consumer law.

1. About Gordina

Our online store is hosted by Shopify, which provides the e-commerce platform through which we offer and sell our products.

2. Using our website

You may use our website only for lawful purposes. You must not:

  • Use the website in a way that violates applicable law or the rights of another person.
  • Attempt to gain unauthorised access to the website, customer accounts or connected systems.
  • Introduce viruses, malicious code or other harmful technology.
  • Scrape, copy or commercially exploit website content without our permission.
  • Submit false, misleading, abusive or unlawful information.

You must be legally capable of entering into a purchase agreement. If you are under the applicable legal age, an authorised parent or guardian must place the order for you.

3. Products and embroidery

Gordina creates garments and accessories that may include made-to-order and embroidered elements. We make reasonable efforts to describe and display every product accurately.

Colours may appear slightly different depending on your screen settings. Small variations in embroidery placement, stitching, texture or finish may occur because of the production process. These natural variations do not affect your statutory rights where a product is faulty or does not conform to its description.

Please review the product description, size information, embroidery options and care instructions before placing an order.

4. Orders and acceptance

When you place an order, you are offering to purchase the selected products. After checkout, we will send an order confirmation to the email address you provided.

We may decline or cancel an order for a valid reason, including:

  • The product is unavailable.
  • Payment could not be authorised.
  • The order information is incomplete or incorrect.
  • We identify an obvious pricing or product-information error.
  • We reasonably suspect fraud, unauthorised resale or unlawful activity.
  • We cannot deliver to the provided address.

If we cannot accept an order after payment has been collected, we will notify you and refund the amount paid using the original payment method.

5. Prices and payment

Prices are displayed in euros unless another currency is shown. Prices include VAT where applicable. Shipping charges and any other applicable costs are displayed before you complete payment.

We may change prices for future purchases, but price changes will not affect an order that we have already accepted.

Available payment methods are shown during checkout. You confirm that you are authorised to use the payment method selected for your order.

6. Made-to-order and personalised products

Some products are prepared or embroidered after an order is placed. Standard Gordina options—such as available sizes, colours, designs or standard embroidery placements—are not automatically treated as personalised products and remain subject to our normal return conditions.

A product is considered genuinely personalised where it is made using customer-supplied text, initials, artwork, bespoke measurements, a non-standard placement or another specification created specifically for that customer.

When providing text, artwork or instructions, you are responsible for checking their accuracy. You also confirm that you own or have permission to use any submitted names, designs, trademarks, images or other materials. We may reject content that is unlawful, offensive or may infringe another person’s rights.

You may request cancellation through your customer account until the order is fulfilled. Once an order has been fulfilled, the withdrawal and return conditions described in our Return and Refund Policy apply.

7. Processing, shipping and delivery

In-stock orders are normally prepared and dispatched within 1–3 business days. Made-to-order products, including garments with a custom embroidery placement, may require up to 5 business days before dispatch.

Delivery times are estimates unless we have expressly agreed to a specific delivery date. Full information about destinations, shipping charges, tracking, customs and import duties is available in our Shipping Policy.

The risk of loss or damage passes to you when you, or a person designated by you, receives the order.

8. Withdrawal, returns and refunds

Consumers generally have the right to withdraw from an online purchase within 14 days after receiving the goods, without providing a reason. Exceptions may apply to genuinely personalised or bespoke products made to the customer’s individual specifications.

Standard Gordina size, colour, design and embroidery-placement options remain returnable when they satisfy the conditions in our Return and Refund Policy.

For change-of-mind returns, the customer is responsible for the direct return shipping cost. Gordina covers the appropriate return costs when an item is faulty, damaged or incorrect.

9. Faulty or incorrect products

Products must conform to the purchase agreement and their description. If an item is faulty, damaged, incorrect or does not perform as reasonably expected, please contact us at info@gordina.com.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction or a refund. These rights are separate from—and are not limited by—the voluntary return conditions in our Return and Refund Policy.

10. Customer accounts

You are responsible for providing accurate and current account, contact, billing and delivery information. Please keep access to your account and verification codes secure.

Notify us promptly if you believe your account has been accessed without permission. We may restrict an account where reasonably necessary to protect customers, prevent fraud or comply with the law.

11. Intellectual property

The Gordina name, branding, website design, photographs, text, embroidery artwork, product designs and other original content are owned by or licensed to Gordina and are protected by applicable intellectual-property laws.

You may view and use this content for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, sell or commercially use our content without prior written permission.

12. Customer submissions

If you send us feedback, reviews, photographs or other content, you remain the owner of your content. Where you choose to publish content through our website or services, you give us the limited permission necessary to display and administer that content.

Customer-provided artwork, text and personalisation materials will be used to process the relevant order. We will not use personalised materials for unrelated promotional purposes without separate permission.

13. Third-party services and links

Our website may contain links to third-party websites or use services supplied by third parties, including Shopify, payment providers and delivery partners.

Third-party websites operate under their own terms and privacy policies. Gordina is not responsible for third-party content or services outside our control. This does not limit our responsibility for the products you purchase directly from Gordina.

14. Website availability and errors

We try to keep the website accurate and available, but temporary interruptions or genuine typographical, technical or pricing errors may occur.

If an obvious error affects an order, we will contact you as soon as reasonably possible. You may confirm the order using the correct information or cancel it for a full refund.

We may update or discontinue website features and future product offers. These changes will not reduce rights attached to an order that has already been accepted.

15. Liability

Gordina is responsible for losses that are a reasonably foreseeable result of our breach of these Terms or our failure to use reasonable care.

We are not responsible for losses caused by:

  • Your misuse of a product or failure to follow its care instructions.
  • Incorrect information or personalisation instructions supplied by you.
  • Events outside our reasonable control, except where applicable law provides otherwise.
  • Business losses where a product was purchased primarily for personal use.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.

16. Events outside our control

We are not responsible for a delay caused by an event outside our reasonable control. If such an event affects your order, we will contact you, take reasonable steps to minimise the delay and resume performance when possible.

Your mandatory cancellation, refund and consumer rights remain unaffected.

17. Personal information

We process personal information as described in our Privacy Policy. This includes information required to process orders, provide customer service, prevent fraud and comply with legal obligations.

18. Complaints

If you have a question or complaint, contact us at info@gordina.com. Please include your order number and a clear description of the issue. We will review your complaint and respond as soon as reasonably possible.

You retain the right to use any consumer complaint or dispute-resolution procedure available to you under applicable law.

19. Governing law

These Terms and purchases from Gordina are governed by the laws of the Netherlands.

If you are a consumer living in another country, this choice of law does not deprive you of any mandatory consumer protections available under the law of your country of residence. Disputes may be brought before a court that has jurisdiction under applicable consumer law.

20. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to our website, business practices or legal requirements. The updated version will be published on this page with a revised date.

Changes will apply to future website use and future purchases. They will not retroactively change an order that has already been accepted unless required by law or agreed with you.

21. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. Any invalid provision will apply only to the extent permitted by law.
